This Privacy Policy describes how EstateBox (“we”, “us”, or “our”) collects, uses, and discloses your personal information on our website (the “Site”), www.estatebox.ca, and through the process of providing you with our EstateBox platform, products and services (“Services”). 

 

We respect your privacy and believe the best way to serve you through our Site and Services is with honesty, accountability and adherence to legal standards. By visiting or interacting with our Site and/or Services, you agree to be bound by the terms of this Privacy Policy. 

 

By using the Site and Services, you agree to the terms of this Privacy Policy and you hereby consent to the collection, use and disclosure of your Personal Information in accordance with this Privacy Policy. Please make sure to read our Terms of Use as it supplements and forms part of this Privacy Policy.

 

We may change this Privacy Policy at any time, and your continued use of our Services indicates your agreement to the revised terms. Accordingly, you should review this Privacy Policy from time to time to keep informed of such amendments. The most recent date of revision will be indicated prominently at the top of the Privacy Policy.

What Does this Privacy Policy Cover?

This Privacy Policy covers our collection, use and disclosure of information about identifiable individuals and information which can be used to identify an individual ("Personal Information"). Personal Information may be collected about visitors to the Site, as well as our customers and other users who use the Site and/or the Services.

This Privacy Policy covers the activities of EstateBox only. This Privacy Policy does not apply to the practices of companies that we do not own or control or other third-party websites. If you submit any Personal Information to EstateBox or the Site or Services, you are responsible for ensuring that you have obtained the necessary authorizations and consents from the relevant individuals in order to make such Personal Information available to us for use in accordance with this Privacy Policy.

Collection of Information 

"Personal Information" for the purpose of this Privacy Policy, “Personal Information” means any information that uniquely identifies you or any other individual or otherwise contains personally identifiable information provided by or obtained from you or any other user of the Site. Personal Information may include certain types of Basic Information, Secure Information, Payment Information and Public Information, each of which is described below.

Basic Information” means the first and last name, email address, gender, postal code, date of birth, and the date and time associated with the creation of your EstateBox and deletion (if applicable) of you or your Delegates on your EstateBox. We may use your Basic Information to operate, provide, and improve the Site and/or Services or to contact you and your Delegates (if applicable) to send information about your EstateBox. 

 

“Secure Information” means your private, sensitive, personal information that you privately submit through the Services, including your health and medical information, financial information and legal information. We will share your Secure Information only with your Delegate and only pursuant to your explicit instruction, except when we are required to by law.

“Payment Information” applies to customers who purchase paid services, and includes a valid credit card number, type, expiration date, name and billing address. This information is collected, stored, used and processed by Stripe Inc. ("Stripe"), our third-party payment processing company, and not by us. Accordingly, the collection, storage, use and processing of your Payment Information is governed by Stripe's applicable terms of service available at https://stripe.com/en-ca/ssa and privacy policy available at https://stripe.com/en-ca/privacy However, sometimes we may request and receive some of your Payment Information from Stripe in order to complete certain transactions you initiated through the Services, to enroll you in a discount or other rebate program you elected to participate in, to protect against or identify potentially fraudulent transactions, or otherwise as necessary to manage our business.

 

“Public Information” means any personally identifying information you post in any public forum through the site. Please remember that any Public Information you post publicly on the Services is not private, and thus may be used or disclosed by any third party who reads such Public Information without our control and without your knowledge, and search engines may index that information. Accordingly, please think carefully before publicly posting any Public Information on the Services.

“Non-Personal Information” does not, on its own, uniquely identify you or anyone else as a specific individual, but rather provides technical data, such as information about your interaction with the Site or about your browser.

“Aggregate Information” means statistical information about how, how often, and when you use the Services and your demographic information. We may use Aggregate Information in order to understand how and how often people use the Services, which in turn allows us to improve them, but never in a way that is personally identifiable.

 

Use of Personal Information 

In order to provide you with your EstateBox and the Site and Services, we need to collect and process information about you. EstateBox may use Personal Information to authenticate access to the Account and provide access to the Services, including through the use of multi-factor authentication; provide, operate, and improve the Site; send technical notices, updates, security alerts and support and administrative messages, including alerts related to your document deadlines and expiry dates; provide and deliver the features of your EstateBox that you request, process and complete transactions, and send you related information, including confirmations and invoices; respond to comments, questions, and requests and provide customer service and support; communicate with customers about services, features, surveys, newsletters, offers, promotions, and provide other news or information about us and our select partners; investigate and prevent fraudulent transactions, unauthorized access to the Services, and other illegal activities; personalize and improve the Site and Services, and provide content, features, and/or advertisements that match your interests and preferences or otherwise customize your experience on the Site or through the Services; monitor and analyze trends, usage, and activities in connection with your EstateBox and for marketing or advertising purpose, enable you to communicate, collaborate, and share files with Delegates; and for other purposes which we will notify you about and seek your consent.

Cookies

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site.    Cookies and other technologies, such as your device’s unique identifier, are used on our website to maximize the website-browsing experience. Specifically, our Site uses cookies for the following purposes: security, connection with user login, indicate the system from which the site was rendered, system monitoring/debugging, cookie banner parameters, anti-fraud, system effectiveness measurement, and stability measurements.

Cookies allow us to track a browser’s movement through the website over several sessions. Through these technologies, the website can recognize repeat visitors, facilitate the visitor’s access to and use of the website and allows the website to track behaviours that will allow content and service improvement. It can also enable us to tailor our website and advertising to better match your interests and preferences. We may also use these technologies to allow you to select and prioritize your preferences when you enter our Site.  

 

No Personal Information is stored in or gathered from these cookies or other technology. However, you may choose to set up your browser to delete and/or refuse cookies or alert you when cookies are sent. Please note, though, if you don’t have a cookie from our Site, it may limit our ability to customize and improve our Site features.

The Services may also use third-party technologies such as scripts and tags. These technologies may be used for analyzing trends, administering the website, tracking most used features of the website, and gathering demographic information about our user base as a whole and we collect this data in an anonymous mode. Various browsers may offer their own management tools for removing these types of tracking technologies.

 

Storage Location and Sub-Processors

We process and store Data, including Personal Information, on servers located in Canada.  We also transfer data to the third-party service providers described on our Sub-Processors webpage. By submitting Personal Information or otherwise using the Services, you agree to this transfer, storing or processing of your Personal Information in the jurisdictions in which our Sub-Processors are located.

Sharing of Information with Delegates

We will share your information with Delegates as designated by you. This could include family members or professional advisors that you choose to designate as a Delegate. Your Delegates will have the ability to, at your election, view, edit, and administer your EstateBox. Your information will only be shared with individuals that you designate as a Delegate. Advisors are bound to protect the confidentiality of your personal information contained in your EstateBox and the information that you provide to the Site.

Disclosure of Information with Third Parties

We do not disclose your Personal Information to third parties except to the extent necessary to enable them to provide the specific services to you or on your behalf. Third-party service providers are contractually bound to maintain the confidentiality of your Personal Information and are prohibited from using your Personal Information for any other purpose. Unless we tell you differently, such third parties do not have any right to use the Personal Information we share with them beyond what is necessary for them to provide the tasks and services on our behalf. The third parties we currently engage include third party companies and individuals employed by us to facilitate our services (for example, payment processing).

 

We may disclose your Personal Information to third parties without your consent if we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other users, or anyone else (including the rights or property of anyone else) that could be harmed by such activities. Further, we may disclose Personal Information when we believe in good faith that such disclosure is required by and in accordance with the law. We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to: satisfy any applicable law, regulation, legal process or governmental request; enforce our contracts (including our Terms of Service), as well as investigation of potential violations of such contracts; and detect, prevent, or otherwise address fraud, security or technical issues.

The above may include exchanging information with other companies and organizations for fraud protection and spam/malware prevention. Notwithstanding the general terms of this policy, the collection, use, and disclosure of Personal Information may be made outside of the terms herein to the extent provided for in any applicable privacy or other legislation in effect from time to time, or pursuant to court orders.

Protection and Security of Personal Information 

EstateBox uses technological safeguards designed to protect your Personal Information from loss and unauthorized access, copying, use, modification or disclosure. We use military-grade encryption and industry-leading technologies such as permission settings, AES-256 encryption, SSO enabled, and TLS 1.2 protocols for the transfer of sensitive information. 

 

We have policies and procedures in place to protect the integrity, privacy and confidentiality of the information that we collect and maintain, including contracts with third parties that manage the information provided by you. Please be aware that, despite our best efforts, no security measures are perfect or impenetrable

 

To help ensure the privacy of your information, we urge you not to share your login details (including your password) with anyone and recommend that you change your password frequently and store it in a safe place. If you are asked to create a username or password, please select words that do not personally identify you. We may offer “auto login” which allows users to enter member areas of our website without re-entering password information. You may want to disable auto login on your device, in order to prevent access by unauthorized users of your device.

Access and Rights to Personal Information

You have the right to access the Personal Information we hold about you in order to verify the Personal Information we have collected in respect to you and to have a general account of our uses of that information. Upon receipt of your written request, we will provide you with a copy of your Personal Information, although in certain limited circumstances, and as permitted under law, we may not be able to make all relevant information available to you, such as where that information also pertains to another user. In such circumstances we will provide reasons for the denial to you upon request. We will endeavour to deal with all requests for access and modifications in a timely manner.

 

We will make every reasonable effort to keep your Personal Information accurate and up to date, and we will provide you with mechanisms to update, correct, delete or add to your Personal Information as appropriate. As appropriate, this amended Personal Information will be transmitted to those parties to which we are permitted to disclose your information. Having accurate Personal Information about you enables us to give you the best possible service.

You may also request that your account, and all your information contained within it, be deleted. In order to do this, please email info@estatebox.ca.

In the event you cancel your account, but don’t request that your account be deleted, your information will stay in our system for 3 months, at which point we will delete all your EstateBox data. We are required to maintain certain information which pertains to your use of the Services (payment transactions, invoices, etc.).

Rights to Change Policy 

We may amend this Privacy Policy from time to time. Use of Personal Information we collect is subject to the Privacy Policy in effect at the time such information is collected, used or disclosed. If we make material changes or changes in the way we use Personal Information, we will notify you by posting an announcement on the Site or sending you an email prior to the change becoming effective. You are bound by any changes to the Privacy Policy when you use the Site or alter your EstateBox after such changes have been first posted.
